TERMS OF SERVICE

1. The Parties

These Terms of Service ("Terms") constitute a binding agreement between AWEN DISTRIBUTION OÜ (registration code: 17434240, registered address: Harju maakond, Tallinn, Kesklinna linnaosa, Juhkentali tn 8, 10132, Estonia) ("Company", "we", "us", "our") and you, the person using our services ("Client", "you", "your").

2. Services

We provide online French language courses through individual and group sessions through Google Meet. The specific details of each course (level, duration, price) are described on our website.

While I strive to use reliable platforms, I am not responsible for any technical issues, outages, or service interruptions originating from these third-party providers.

3. Booking and Payment

  • Lessons can be booked through our Google Calendar or by email at frenchwithcarine@gmail.com

  • Payment for new student is required in advance to confirm your booking or with agreement

  • Current students may choose to pay in advance or after the lesson, in blocks of 4 or more lessons, according to their preference.

  • Payments are accepted in Euros (EUR) via bank transfer (Wise) (IBAN provided for European and International clients) or via a secure payment link (Wise or Stripe).

  • All prices are in Euro(€) and include applicable taxes

  • Validity Period: All pre-paid lessons or packages must be completed within 40 days from the date of payment. After this 40-day period, any unused credits will expire and will not be eligible for a refund.

  • While I strive to use reliable platforms, I am not responsible for any technical issues, outages, or service interruptions originating from these third-party providers.

4. Cancellation and Refund Policy

  • Cancellation by Client: You may cancel or reschedule a lesson up to 12 hours before the scheduled start time for a full refund. Any lesson not attended or canceled less than 12 hours before the scheduled time will be charged in full.

  • Cancellation by Us: In the unlikely event that we need to cancel a lesson, you will receive a full refund or the option to reschedule.

  • Group sessions: Refunds for group sessions follow the same policy. If minimum participation is not met, we reserve the right to cancel the session with a full refund.

  • 30-Day Progress Guarantee: For online training programs, a refund may be requested after 30 days provided the student provides written justification and evidence (completed exercises, notes) demonstrating that no pedagogical progress was made despite full participation in the course.

  • For EU consumers: If you are a consumer residing in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason unless the service has already been used (e.g., course taken, access to content). This right does not apply to lessons already provided before the withdrawal.

5. Client Responsibilities

  • You are responsible for ensuring you have a stable internet connection and appropriate device for online lessons

  • You are responsible for joining lessons on time via Google Meet.

  • You agree to attend lessons on time; lessons will not be extended for late arrivals

  • You agree to behave respectfully toward the teacher

  • Course materials (Google Docs) are for personal use only and may not be shared or distributed without permission.

6. Code of Conduct & Right of Termination

  • Inappropriate Behavior: I reserve the right to immediately terminate any lesson, subscription, or access to the platform without notice or refund if a student’s behavior or language is deemed inappropriate, disrespectful, or offensive.

  • Modifications: I reserve the right to immediately terminate any lesson or subscription without refund if a student’s behavior or language is deemed inappropriate, offensive, or disrespectful.

7. Intellectual Property

  • Accuracy of Content: While I strive for excellence, all content is provided for educational purposes "as is." I am not liable for any unintentional errors, omissions, or inaccuracies within the teaching materials.

  • Intellectual Property: All materials (videos, PDFs, quizzes, etc.) are protected by copyright. Any unauthorized duplication, distribution, or illicit use of the content or the platform is strictly prohibited and may lead to legal action.

  • Third-Party Services: By using this site, you acknowledge that I use third-party services (e.g., Wise, Systeme.io, Google Drive). I am not responsible for any issues arising from their side.

8. Limitation of Liability

To the maximum extent permitted by Estonian law, our total liability shall not exceed the amount you paid for the specific lesson giving rise to the claim. We are not liable for any indirect or consequential losses.

9. Governing Law

Governing Law and Dispute Resolution These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Harju County, Estonia.

For EU consumers: If you reside in the European Union, mandatory provisions of your local consumer protection laws (including the right of withdrawal) will also apply. However, the primary governing law for these Terms remains Estonian law.

For international clients: If local laws in your country of residence provide additional consumer protections (e.g., mandatory cooling-off periods or specific dispute resolution mechanisms), those laws may also apply. However, the primary governing law for these Terms remains Estonian law.

10. Right of Withdrawal

Right of Withdrawal (for EU Consumers Only)

If you are a consumer residing in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract (i.e., after booking your first lesson).

To exercise this right, you must inform us of your decision to withdraw by sending a clear statement (e.g., via email to awentlp@proton.me). If you withdraw, we will reimburse all payments received from you, except for lessons already provided before the withdrawal.

Note: This right does not apply to clients outside the EU. Local consumer laws in your country may provide similar rights—please consult the relevant regulations in your jurisdiction.

11. Communication and Lesson Materials

  • Direct communication with students is conducted via WhatsApp, Telegram, iMessage, or email, based on the student’s preference.

  • Course content, when applicable, is shared via a Google Doc accessible only to the student.
